Standard Photography Terms & Conditions
Last updated: 5 November 2026
These Terms & Conditions apply to standard photography services provided by Abigail Thompson Photography, including studio photography, family portraits, children's photography, pet photography, outdoor sessions and seasonal photography sessions.
Wedding photography is governed by separate Terms & Conditions. Special events and experiences may have additional booking conditions, which will be communicated before payment.
1. Bookings & Acceptance of Terms
A minimum booking deposit of £10 is required to secure a photography session, unless otherwise stated at the time of booking.
By proceeding with a booking and paying the required deposit, the client confirms that they have been given the opportunity to read and agree to these Terms & Conditions before payment.
Payment of the deposit constitutes acceptance of these Terms & Conditions and forms a booking agreement between the client and Abigail Thompson Photography. A separate signed agreement is not required.
Bookings are confirmed once the required deposit has been received and booking confirmation has been issued.
All deposits are deducted from the total price of the photography package purchased.
2. Payments
The remaining balance must be paid in full before the photography session begins.
Payment information and any outstanding balance will be communicated at the time of booking.
Additional products, prints, editing requests or services not included in the selected package may incur additional charges. These will always be communicated and agreed before additional work is undertaken.
3. Cancellations & Rescheduling
Abigail Thompson Photography kindly requests a minimum of 48 hours' notice for cancellations or rescheduling.
Where at least 48 hours' notice is provided, every effort will be made to arrange an alternative date and time convenient for the client.
If the client does not wish to reschedule, or a mutually suitable alternative cannot be arranged, the booking deposit will be refunded.
Where less than 48 hours' notice is provided, some or all of the booking deposit may be retained where reasonable and proportionate to the losses resulting from the cancellation, taking into account any costs saved or replacement bookings secured.
Clients who fail to attend their appointment without prior notice may also be subject to reasonable cancellation charges.
Abigail Thompson Photography understands that unexpected circumstances, including illness and emergencies, can arise. Such situations will be considered individually wherever possible.
These arrangements do not override applicable statutory cancellation rights.
4. Statutory Consumer Cancellation Rights
For bookings made online, by telephone or away from business premises, clients may have a statutory 14-day cancellation right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Whether this right applies depends on the nature of the booking and any relevant statutory exemptions.
Where a statutory cancellation right applies, clients will receive the cancellation information required by law before entering into the booking agreement.
If a client expressly requests that photography services begin during an applicable cancellation period, any charges following cancellation will be determined in accordance with the relevant consumer legislation.
Nothing in these Terms & Conditions restricts or removes statutory cancellation rights.
5. Late Arrivals & Missed Appointments
Abigail Thompson Photography operates an appointment-based diary system.
Photography sessions begin at the allocated booking time. Clients arriving late may therefore have less time available for their session.
Where possible, Abigail will endeavour to accommodate the full session duration. However, this cannot be guaranteed where other bookings or commitments are scheduled.
Clients are encouraged to contact Abigail Thompson Photography as soon as possible if they anticipate arriving late.
6. Photographer Illness or Cancellation
In the unforeseen event that Abigail is unable to fulfil a booking due to illness, emergency or other circumstances, clients will be contacted as soon as reasonably possible.
Clients will be offered the opportunity to reschedule their photography session to a mutually convenient date, with their existing deposit honoured.
Where rescheduling is unsuitable, all payments received for the cancelled session will be refunded in full.
This does not affect any additional remedies available under applicable consumer law.
7. Photography Sessions & Packages
Photography session durations, the number of edited photographs provided and any included products vary depending on the photography package purchased.
Full package details will be communicated before booking.
Abigail Thompson Photography aims to provide a relaxed, enjoyable and professional photography experience.
Every effort will be made to capture a varied selection of high-quality photographs. However, specific poses, expressions or individual images cannot be guaranteed.
8. Children, Pets & Supervision
Abigail Thompson Photography welcomes children and pets and aims to provide a comfortable and enjoyable environment for all clients.
Children and animals must remain under the supervision of a responsible adult throughout the photography session.
The studio contains professional photographic equipment, lighting, props, mirrors and large photographic frames.
Although safety precautions are in place, including a baby gate, photography props are not toys and must not be played with or handled without permission.
Parents, guardians and pet owners are expected to take reasonable care to prevent accidents, injuries or damage.
Abigail Thompson Photography reserves the right to pause or stop a photography session where an immediate safety concern arises.
9. Studio Access & Accessibility
Abigail Thompson Photography is located at:
First Floor, 28 Middle Street
Consett, County Durham
DH8 5QJ
The studio is situated on the first floor and is accessible via stairs. There is currently no lift access.
Accessibility is important to Abigail Thompson Photography, and clients with specific accessibility requirements are encouraged to make contact before booking.
Where possible, alternative arrangements or suitable locations can be discussed.
The studio is pet-friendly. Although every reasonable effort is made to thoroughly clean the studio between sessions, an allergen-free environment cannot be guaranteed.
Clients with allergies, particularly severe animal allergies, are encouraged to discuss their requirements before booking. Where appropriate, an alternative location or non-pet-friendly photographer may be recommended.
10. Studio Equipment, Props & Property
Clients are kindly asked to respect the studio environment, furniture, photographic equipment and props.
Props, displays, mirrors and photographic frames should not be moved or handled without permission.
While Abigail Thompson Photography encourages a relaxed and enjoyable atmosphere, the safety of clients, particularly younger visitors, remains a priority.
Any accidental damage should be reported to Abigail as soon as possible.
Incidents involving damage to studio property will be considered individually, taking into account the circumstances and any legal responsibility for the damage.
Normal wear and tear will not be treated as client damage.
11. Personal Photography & Video
Clients are welcome to capture occasional personal photographs or short videos during their visit to the studio.
Abigail Thompson Photography encourages clients to enjoy their experience and share their visit where appropriate.
Clients are kindly asked to ensure that personal photography or filming does not interfere with the professional photography session, equipment or the privacy of other clients.
12. Outdoor Photography & Weather Conditions
Outdoor photography sessions are subject to suitable weather and environmental conditions.
Where adverse weather makes an outdoor session unsuitable, clients may be offered the opportunity to move their session to the studio or reschedule to another available date.
Weather-related rescheduling for outdoor photography sessions is exempt from the standard 48-hour cancellation notice requirement where conditions materially affect the planned session.
Abigail Thompson Photography will endeavour to arrange a suitable alternative wherever reasonably possible.
13. Image Selection & Editing
The number of edited photographs provided will be determined by the photography package purchased.
All photographs are professionally selected and edited in the established photographic style of Abigail Thompson Photography.
Clients with specific editing preferences or requests are encouraged to discuss these before their photography session.
Abigail Thompson Photography offers up to three individual editing refinements free of charge per booking following delivery of the completed photographs.
Any additional refinements beyond the three included will be charged at £15 per individual refinement, with the cost confirmed and agreed before additional editing is undertaken.
A refinement refers to a reasonable individual adjustment to an already edited photograph.
More extensive alterations, advanced retouching or significant changes to the original editing style may require a separate quotation.
Corrections required because the original service has not been provided with reasonable care and skill will not count towards the complimentary refinement allowance or incur additional charges.
14. Digital Image Delivery
Abigail Thompson Photography aims to deliver all professionally edited digital photographs within seven (7) working days following the photography session.
While photographs are often delivered sooner, this timeframe allows for the careful selection, editing and preparation of images to a professional standard.
Working days exclude weekends and public holidays in England.
Specific Delivery Requirements
Clients requiring their photographs by a specific date, including for birthdays, anniversaries, gifts or other occasions, must communicate this requirement before confirming their booking.
Abigail Thompson Photography will endeavour to accommodate specific delivery requests wherever possible. Any agreed delivery deadline will be confirmed before the booking is finalised.
Christmas & Seasonal Photography
For Christmas photography sessions taking place close to Christmas Day, Abigail Thompson Photography will prioritise the editing and delivery of photographs to ensure clients receive their images as promptly as possible.
Where delivery before Christmas Day is agreed as part of the booking, photographs will be delivered within the agreed timeframe, subject to the client's statutory rights and any remedies available if delivery is delayed.
Larger Commissions & Delays
For larger commissions, events or sessions requiring extensive editing, an alternative delivery timeframe may be agreed before booking.
In the unlikely event of an unforeseen delay, Abigail Thompson Photography will notify the client as soon as reasonably possible and provide an updated estimated delivery date.
Completed digital photographs will be delivered electronically using the method agreed with the client.
Nothing within this section affects the client's statutory consumer rights.
15. RAW & Unedited Photographs
RAW files and unedited photographs are not included in standard photography packages and will not ordinarily be supplied to clients.
Abigail Thompson Photography retains professional discretion over image selection and editing, subject to the services agreed and applicable consumer rights.
16. Image Storage & Retention
Abigail Thompson Photography takes reasonable precautions to protect and securely store digital photographs.
Original and unedited photographs will normally be retained for up to six months following delivery of the completed gallery.
Final edited photographs will normally be retained for up to twelve months following delivery.
After these periods, images may be permanently deleted unless continued retention is necessary for a lawful business or legal purpose.
Clients are strongly encouraged to download and securely back up their photographs following delivery.
Abigail Thompson Photography does not provide a permanent image storage or archiving service.
Personal information and photographs will be retained and deleted in accordance with the business's Privacy Policy and applicable data protection legislation.
17. Technical Failure & Image Loss
Abigail Thompson Photography takes reasonable precautions to minimise the risk of equipment failure, image corruption and accidental loss of photographs.
In the unlikely event that photographs are lost or damaged, reasonable efforts will be made to recover the affected files.
Where an entire photography session cannot be delivered, the client will be offered a complimentary replacement session where appropriate or a full refund of the affected photography service.
Where only part of the agreed service is affected, an appropriate remedy will be offered according to the circumstances.
Nothing within this section limits the client's statutory consumer rights.
18. Copyright & Personal Image Usage
Copyright in photographs created by Abigail Thompson Photography remains with Abigail Thompson Photography unless otherwise agreed in writing.
Clients purchasing standard photography packages receive permission to download, print and share their delivered photographs for personal, non-commercial purposes.
Clients are welcome to share their photographs on personal social media accounts and arrange personal prints through third-party printing services.
Photographs may not be sold, commercially licensed or used for commercial advertising without prior written agreement.
19. Commercial & Third-Party Usage
Any intended commercial use of photographs must be discussed and agreed with Abigail Thompson Photography in advance.
This includes use by businesses, publications, advertisers or other commercial third parties.
Additional licensing fees may apply depending on the intended use.
Commercial usage permissions will be confirmed in writing where applicable.
20. Prints & Personalised Products
Abigail Thompson Photography takes reasonable care to inspect printed products before supplying them to clients.
Clients ordering personalised products will be asked to confirm their chosen photographs and any relevant personalisation details before production.
Once an order has entered production, changes may not be possible.
Where a product is faulty, damaged, incorrectly supplied or otherwise fails to meet statutory requirements, Abigail Thompson Photography will provide an appropriate remedy in accordance with consumer law.
Personalised products may be exempt from certain change-of-mind cancellation rights, but this does not affect rights relating to faulty or misdescribed goods.
21. Promotional Photography & Model Releases
Clients will be asked to complete a separate Image & Data Consent / Model Release form.
This form allows clients to specify whether their photographs may be used for purposes including website portfolios, social media, studio displays, advertising and promotional materials.
Consent for promotional use is entirely optional.
Declining promotional consent will not affect the photography service purchased or the photographs delivered.
Photographs will only be used for promotional purposes where an appropriate lawful basis and any required permissions have been established.
Clients may contact Abigail Thompson Photography to withdraw consent for future consent-based promotional use. Withdrawal will be handled in accordance with applicable data protection legislation.
22. Privacy & Data Protection
Abigail Thompson Photography processes personal information in accordance with applicable UK data protection legislation.
Information collected may include client names, contact details, booking information, payment records, photographs and consent records.
Personal information will be used for appropriate business purposes, including managing bookings, providing photography services, fulfilling orders and meeting legal obligations.
Further information about data retention, lawful bases for processing, individual rights and contact procedures will be provided in the business's separate Privacy Policy.
23. Complaints & Dispute Resolution
Abigail Thompson Photography aims to provide a professional, friendly and high-quality service.
If a client is dissatisfied with any aspect of their experience, they are encouraged to contact Abigail Thompson Photography as soon as reasonably possible so the matter can be investigated.
Every reasonable effort will be made to resolve complaints fairly and promptly.
Nothing in this section restricts a client's statutory rights or access to legal remedies.
24. Liability & Consumer Rights
Abigail Thompson Photography will provide photography services with reasonable care and skill.
Nothing within these Terms & Conditions excludes or restricts liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded.
Nothing in these Terms & Conditions removes or limits the client's statutory rights under applicable UK consumer protection legislation.
25. Governing Law
These Terms & Conditions are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply.
